Introduction

Welcome to www.claimdost.com (the “Site”) and the Claim Dost mobile application (the “Mobile Application”), each owned and operated by Assure Mantra Venture & Consultancy Private Limited (“Claim Dost,” “we,” “us,” or “our”).

Claim Dost provides its services to you subject to the terms and conditions set out below (this “Terms of Use” or “ToU”). Before using the Site or the Mobile Application, you must read and accept this ToU, our Privacy Policy, and any other legal or administrative policies referenced herein. We recommend that you also read the documents linked within this ToU, as they are incorporated into and form part of it.

This ToU takes effect upon your acceptance. Using any functionality of the Site or the Mobile Application constitutes your acceptance of this ToU. Where this ToU conflicts with any other document, this ToU shall govern your use of the Site and the Mobile Application. If you do not agree to be bound by this ToU and the Privacy Policy, you may not use the Site or the Mobile Application in any manner.

We may change or otherwise modify this ToU at any time, at our sole discretion and without prior notice. We encourage you to review this page periodically. Your continued access to or use of the Site or the Mobile Application after any such change constitutes your acceptance of the updated ToU.

If you fail to comply with the Privacy Policy, this ToU, or any other applicable policy — whether intentionally or otherwise — Claim Dost reserves the right to terminate your access to the Site or the Mobile Application and/or your account (together, “Access”), to remove any non-compliant information you have provided, or both.

By accepting this ToU, you provide Claim Dost with a formal mandate to represent you before the insurer and to communicate the grant of cover to you once insurance has been effected. This mandate is valid for eighteen (18) months, unless otherwise agreed in writing between you and Claim Dost. No mandate is required for pre-underwritten policies or individual policies.

1. Description of Services

Through the Site and the Mobile Application, Claim Dost provides users with information relating primarily to financial and insurance products and services, and offers claim-consultancy services where a policyholder has lodged a claim and engaged us as a claim consultant in respect of General Insurance, Life Insurance, and related products (the “Service”).

You are solely responsible for obtaining access to the Site and the Mobile Application, which may involve third-party charges, such as internet service provider or airtime fees. You are also responsible for procuring and maintaining all equipment necessary for such access.

By using the Site or the Mobile Application and providing your personal or contact details, you confirm that you are interested in availing or purchasing the Service(s) you have selected. You agree that Claim Dost may contact you electronically or by phone to understand your interest in the selected products and Service(s) — including in relation to recurring payments and reminders — and to fulfil your request.

You further agree that Claim Dost may share your details with its affiliates and partners, who may contact you regarding relevant products and offers by email, telephone, or SMS. You agree to receive promotional materials and special offers from Claim Dost by email or SMS.

2. License and Access to the Site / Mobile Application

Claim Dost grants you a limited, personal, non-transferable license to access and use the Site and the Mobile Application and the Service. This license does not permit you to:

  • download or copy any information for the benefit of any other individual, vendor, or third party;

  • cache the Site or Mobile Application, create unauthorised hyperlinks to it, or frame any of its content;

  • upload, post, or transmit any content that you do not have the right to make available, including the intellectual property of another party;

  • upload, post, or transmit any material containing viruses or other code designed to interrupt, damage, or limit the functionality of any software, hardware, or telecommunications equipment;

  • take any action that imposes, or may (in Claim Dost's sole discretion) impose, an unreasonable or disproportionate load on Claim Dost's infrastructure; or

  • use data mining, robots, or similar data-gathering or extraction tools, or otherwise bypass any measure used by Claim Dost to prevent or restrict access to the Site or Mobile Application.

Any unauthorised use by you will automatically terminate the license granted under this ToU. In addition, you agree that you will not:

  • use the Site or Mobile Application, or its content, for any commercial purpose;

  • make any speculative, false, or fraudulent transaction, or any transaction made in anticipation of demand;

  • access, monitor, or copy any content or information on the Site or Mobile Application using a robot, spider, scraper, or other automated or manual means, without our express written permission;

  • violate any robot-exclusion header, or bypass or circumvent any measure employed to prevent or limit access to the Site or Mobile Application;

  • deep-link to any part of the Site or Mobile Application, including any purchase path, without our express written permission; or

  • frame, mirror, or otherwise incorporate any part of the Site or Mobile Application into another website without our prior written authorisation.

3. Eligibility

The Service is not available to minors under the age of eighteen (18) or to any user who has been suspended or removed from the Site or Mobile Application by Claim Dost for any reason. A user may not hold more than one active account, and users are prohibited from selling, trading, or otherwise transferring their account to any other party. If you do not meet these eligibility requirements, you may not use the Service, the Site, or the Mobile Application.

4. Your Account

By using the Site or the Mobile Application, you represent that you are of legal age to enter into a binding contract, are not barred from receiving these services under the laws of India or any other applicable jurisdiction, and will use the Site or Mobile Application only to make legitimate purchases for yourself or for a person on whose behalf you are legally authorised to act. Where you act on behalf of another person, you agree to inform that person of the applicable ToU and Privacy Policy, including all rules and restrictions relevant to the purchase made on their behalf.

You agree to provide true, accurate, current, and complete information about yourself as prompted on the Site or Mobile Application. If any information you provide is, or becomes, untrue, inaccurate, outdated, or incomplete — or if Claim Dost has reasonable grounds to suspect this is the case — Claim Dost may suspend or terminate your account and refuse any current or future use of the Site or Mobile Application, in whole or in part.

You are responsible for maintaining the confidentiality of your account credentials and for restricting access to your device, and you accept responsibility for all activity that occurs under your account. We strongly recommend that you log out of your account at the end of each session. You agree to notify Claim Dost immediately of any unauthorised use of your account or any other breach of security.

Claim Dost reserves the right, at its sole discretion, to refuse service, terminate accounts, or remove or edit content, and to deny access to the Site or Mobile Application to any person at any time and for any reason, including for violation of this ToU or the Privacy Policy.

Additional terms may apply to specific Services you select, and you should read them carefully. You agree to comply with the terms and conditions of any service provider you elect to deal with, including timely payment of all amounts due and compliance with that provider's rules regarding use of its products or services. Violation of a service provider's rules may result in cancellation of your purchase, denial of access to the relevant service, forfeiture of amounts paid, and/or our debiting your account for any costs we incur as a result.

5. Submitted Content

Claim Dost does not claim ownership of any material you make available through the Site or Mobile Application. Such material may, at Claim Dost's sole discretion, be included in the Service in whole, in part, or in modified form. By submitting or making available any such material, you grant Claim Dost a perpetual, irrevocable, worldwide, royalty-free, non-exclusive license to use, copy, distribute, publicly display, modify, create derivative works from, and sublicense that material (including any name you submit in connection with it).

You represent and warrant that any material you submit does not include anything you do not have the full right to license as set out in this Section. We assume no responsibility or liability for content submitted by users, and we have no obligation to publish any comment; we retain absolute discretion over which submissions are published.

If you do not agree to these terms, please do not submit any content. You are solely responsible for the content you submit, and you are prohibited from posting or transmitting to or from the Site or Mobile Application:

  • any unlawful, threatening, libellous, defamatory, obscene, or pornographic material, or any material that violates rights of publicity or privacy or any applicable law;

  • any commercial material, including solicitations, advertising, or marketing of goods or services; or

  • any material that infringes or misappropriates any copyright, trademark, patent, or other proprietary right of a third party.

You will be solely liable for any damage arising from a breach of the above restrictions or from your posting of content to the Site or Mobile Application.

6. Disclaimer of Liability and Warranty

The content, products, and services published on the Site or Mobile Application may contain inaccuracies or errors, including pricing errors. We do not guarantee the accuracy of, and disclaim all liability for, such errors or inaccuracies, and we expressly reserve the right to correct any pricing error, including on pending reservations made at an incorrect price.

Claim Dost makes no representation as to the suitability, for any purpose, of the information, software, products, and services on the Site or Mobile Application, and the inclusion of any product or service does not constitute an endorsement or recommendation. All such information, software, products, and services are provided “AS IS,” without warranty of any kind, and Claim Dost disclaims all implied warranties and conditions, including those of merchantability, fitness for a particular purpose, title, and non-infringement, including as to whether the Site, Mobile Application, or any Claim Dost email is free of viruses or other harmful components.

Service providers offering services through the Site or Mobile Application are independent affiliates, and Claim Dost is not liable for their acts, errors, omissions, representations, warranties, breaches, or negligence, or for any resulting personal injury, death, property damage, or other loss or expense. Claim Dost and its affiliates are not liable, and will not issue any refund, for delay, cancellation, strike, force majeure, or other cause beyond their reasonable control, including the omissions, delays, or acts of any government or authority.

To the fullest extent permitted by law, Claim Dost and its affiliates shall not be liable for any direct, indirect, punitive, incidental, special, or consequential damages arising out of or connected with your access to, or use or display of, the Site or Mobile Application, or your inability to access, use, or display it — including in reliance on any opinion appearing on it, or arising from any computer virus, information, software, linked site, product, or service obtained through it — whether based in negligence, contract, tort, strict liability, or otherwise, and even where Claim Dost or its service providers have been advised of the possibility of such damages.

7. Disclaimer of Online Availability, Impressions, and Click-Throughs

In addition to the other disclaimers in this ToU, Claim Dost gives no guarantee or warranty regarding the online availability of www.claimdost.com, its web pages, or any material, information, links, or content presented on them, all of which may be unavailable for online access at any time.

Any advertising sponsor or advertisement, if permitted, must be approved by Claim Dost before being posted on www.claimdost.com. Claim Dost reserves the right to accept or reject any advertising sponsor or advertisement for any reason.

8. Cancellation, Refund, and Chargeback Terms

8.1 Agreement Fee

We encourage every customer to read the applicable service level agreement carefully and to sign it only once satisfied that it meets their requirements. An agreement fee, as mutually discussed and agreed, applies and is non-refundable unless cancellation is mutually agreed between the parties.

8.2 Chargebacks

You (as cardholder) may dispute a transaction carried out through our Site and file a chargeback with your issuing bank for reversal of that transaction. A chargeback allows a transaction to be reversed in specified circumstances, including:

  • alleged forgery of the card, bank account, or other details;

  • a charge or debit made on a card that has been hotlisted or otherwise listed on a card association (Visa, Mastercard, etc.) warning bulletin;

  • duplicate processing of the transaction; or

  • any other reason permitted under applicable rules and guidelines issued by the RBI, card associations, or your card or payment-instrument issuer.

Claim Dost reserves the right to reject a chargeback request.

9. Customer Due Diligence (CDD) Requirements

You acknowledge that, for any financial transaction conducted through the Site, Claim Dost may undertake customer due-diligence measures and request the information necessary for KYC purposes, in accordance with applicable law, in order to facilitate your insurance request with the relevant insurance company or companies. You are obliged, as a customer, to provide such information.

Where required, you consent to and authorise Claim Dost to obtain your credit information through authorised entities. Claim Dost may obtain sufficient information to establish, to its own satisfaction and that of the insurance company, the identity of each new customer and the intended nature of the insurance relationship between you and the insurance company or companies.

You agree that any payment must be remitted only from your own bank account, or from a joint account in which you are a joint holder. If a premium payment is remitted from an account held in the name of a third party, you agree that Claim Dost may undertake enhanced due-diligence measures, including additional documentation, to satisfy its customer due-diligence requirements.

10. License Disclaimer

Nothing on any Claim Dost website shall be construed as conferring, by estoppel, implication, or otherwise, any license under any intellectual property right of Claim Dost or of any third party.

11. Local Laws

Claim Dost complies with applicable local, state, and central laws. We will provide information within our control or possession, or other assistance, to any government agency lawfully authorised to investigate matters or protect cybersecurity, for the purposes of verifying identity or of preventing, detecting, investigating, or prosecuting an offence under applicable law, or in relation to a cybersecurity incident, as soon as possible and, in any event, within seventy-two (72) hours of receiving an order, or within any timeline specified in a government or regulatory order.

Our Grievance Officer and legal team are authorised to receive and acknowledge any order, notice, or direction issued by the appropriate government, a competent authority, or a court of competent jurisdiction.

Claim Dost operates the Site from its headquarters in Ranchi, India, and makes no representation that the material on the Site is appropriate or available for use in other locations. If you access the Site from another location, you are responsible for complying with applicable local laws, including export and import regulations. Unless stated otherwise, all marketing and promotional material on the Site is directed solely at individuals, companies, and other entities located in India and complies with the laws of India. Any dispute is subject to the exclusive jurisdiction of the courts at Ranchi.

12. Limitation of Liability

You agree that Claim Dost and its subsidiaries, affiliates, officers, employees, agents, partners, and licensors shall not be liable to you for any direct, indirect, incidental, special, consequential, or exemplary damages — including damages for loss of profits, goodwill, use, data, or other intangible losses — arising from your use of the Site or Mobile Application, its content, or any related service, even where Claim Dost has been advised of the possibility of such damages.

If, notwithstanding the foregoing, Claim Dost or its affiliates are found liable for any loss or damage connected with the matters described above, their aggregate liability shall not exceed the greater of (a) the service fees you paid to Claim Dost in connection with the relevant transaction on the Site or Mobile Application, or (b) Indian Rupees One Hundred (INR 100).

This limitation reflects the allocation of risk between the parties and shall survive and apply even if any limited remedy provided under this ToU is found to have failed of its essential purpose. It inures to the benefit of Claim Dost, its affiliates, and their respective service providers.

13. Indemnity

You agree to indemnify and hold harmless Claim Dost, its officers, directors, agents, subsidiaries, joint ventures, and employees from and against any claim, cause of action, demand, loss, damage, fine, penalty, or other cost or expense of any kind, including reasonable attorneys' fees, arising out of or related to your breach of this ToU, your violation of any law or of the rights of a third party, or your use of the Site or Mobile Application.

14. Electronic Communication

When you use the Site or Mobile Application, or send an email to Claim Dost, you are communicating with us electronically, and you consent to receive communications from us electronically, including by email and WhatsApp. Claim Dost may communicate with you by email, by posting a notice on the Site or Mobile Application, by phone, or through any other generally available means of communication, including WhatsApp. You agree that any agreement, notice, disclosure, or other communication provided electronically satisfies any legal requirement that it be in writing.

15. Site-Provided Email and Postings

The Site or Mobile Application may allow users to send messages to other users or non-users, and to post messages (“Postings”). Claim Dost is under no obligation to review any Posting and assumes no responsibility or liability in relation to it, although Claim Dost may, from time to time, monitor Postings and may decline to accept, or may remove, any email or Posting.

You agree not to use any functionality of the Site or Mobile Application to post content, initiate communications, or otherwise host, display, upload, modify, publish, transmit, store, or share any information that:

  • is unlawful, harmful, threatening, abusive, harassing, defamatory, vulgar, obscene, profane, hateful, or otherwise objectionable, including material that would constitute a criminal offence, give rise to civil liability, or otherwise violate applicable law, or that is invasive of another's privacy (including bodily privacy), insulting or harassing on the basis of gender, or relates to money laundering or gambling;

  • constitutes an advertisement or solicitation of any kind;

  • impersonates another person, or is false or misleading as to its origin or content;

  • includes personal information such as phone numbers, account numbers, addresses, or employer references belonging to a third party;

  • purports to be an official communication from Claim Dost by a non-spokesperson employee, or discloses confidential information or opinions concerning Claim Dost;

  • offers unauthorised downloads of copyrighted or private information, or infringes any patent, trademark, copyright, or other proprietary right;

  • consists of repeated, substantially similar messages restating the same point, chain letters, or identical unsolicited messages sent to multiple recipients advertising a product, service, or political message;

  • is harmful to a child, or is patently false and intended to mislead or harass a person, entity, or agency for financial gain or to cause injury; or

  • threatens the unity, integrity, defence, security, or sovereignty of India, or India's friendly relations with foreign states, incites the commission of a cognisable offence, prevents the investigation of any offence, or contains a virus or other harmful code.

This prohibition also extends to using Claim Dost to message people who do not know you or would not recognise you as a known contact, to send unsolicited promotional messages to connections without their permission, or to send messages to distribution lists, newsgroups, or group aliases.

16. Links

The Site or Mobile Application, or third parties, may provide links to other websites or resources. Claim Dost has no control over such sites or resources and is not responsible for their availability, and does not endorse and is not responsible or liable for any content, advertising, products, or other material available on or through them. You agree that Claim Dost shall not be responsible or liable, directly or indirectly, for any damage or loss caused, or alleged to be caused, by or in connection with your use of, or reliance on, any such content, goods, or services.

17. Access to Password-Protected and Secure Areas

Access to password-protected or otherwise secure areas of the Site or Mobile Application is restricted to authorised users. Any unauthorised attempt to access such areas may result in prosecution.

18. Modification and Notification of Changes

Claim Dost reserves the right to modify the Site or Mobile Application, related policies and agreements, this ToU, and the Privacy Policy at any time. Where a modification to this ToU is material, we will provide notice by displaying a prominent announcement above the text of the ToU or Privacy Policy, as applicable, for thirty (30) days; such display shall be deemed sufficient notice, and the notice will be removed once the thirty (30) day period has elapsed.

If you have not used the Site or Mobile Application for more than thirty (30) days, you should review this ToU and the Privacy Policy before further use. All information and content available on or through the Site or Mobile Application, including any software (“Content”), is protected by copyright. Users may not modify, copy, distribute, transmit, display, publish, sell, license, create derivative works from, or otherwise use any Content for a commercial or public purpose.

20. Survival of Terms

Notwithstanding any other provision of this ToU or any general legal principle to the contrary, any provision of this ToU that imposes or contemplates a continuing obligation on a party will survive the expiration or termination of this ToU.

21. General

If any provision of this ToU is held invalid, void, or unenforceable, the parties agree that a court should give effect to the parties' intentions as reflected in that provision to the extent possible; the unenforceable provision shall be severable and shall not affect the validity or enforceability of the remaining provisions. Headings are for reference only and do not limit the scope of any section.

Except as expressly provided herein, this ToU confers no rights on any third-party beneficiary. This ToU constitutes the entire agreement between you and Claim Dost governing your use of the Site and the Mobile Application, and supersedes any prior agreement between you and Claim Dost on that subject.
